Terms & Conditions

These Terms & Conditions ("Terms") govern your use of epic.inc and any of its subdomains (together, the "Site"), operated by EPIC Agency LLC ("EPIC," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

These Terms cover the Site only. Client services are governed by a separate written agreement between EPIC and the client, and if there's any conflict, that agreement controls.

Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable law or regulation
• Copy, scrape, harvest, or systematically collect content or data from the Site, including by automated means, without our written permission
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems
• Interfere with the Site's operation, including by introducing malware or overloading our infrastructure
• Submit false, misleading, or fraudulent information through our forms
• Impersonate any person or organization, or misrepresent your affiliation with anyone
• Use the Site to send unsolicited commercial communications

We may suspend or block access to the Site at our discretion, without notice, if we believe these Terms have been violated.

Our content and intellectual property

Unless otherwise noted, the Site and everything on it — text, design, graphics, logos, photographs, video, code, and the selection and arrangement of all of it — is owned by EPIC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for your own personal or internal business reference, provided you keep all copyright and proprietary notices intact. You may not otherwise reproduce, modify, distribute, publicly display, or create derivative works from Site content without our prior written consent.

"EPIC," the EPIC logo, and related marks are trademarks of EPIC Agency LLC. Other names, logos, and marks appearing on the Site — including those of clients, partners, publishers, and media outlets — belong to their respective owners and are used for identification purposes only. Their appearance does not imply endorsement of EPIC by those owners, or of those owners by EPIC, beyond the relationship described.

Testimonials, client work, and media coverage

The Site features testimonials from clients and partners, examples of campaigns and projects, and links to press and media coverage. Testimonials reflect the individual experiences and opinions of the people who gave them and are not a guarantee of results. Media coverage is linked or excerpted for informational purposes; the underlying content belongs to the publishing outlet.

Results described on the Site — bestseller placements, audience reach, fundraising outcomes, and similar — are specific to the circumstances of those engagements. Past results do not guarantee future outcomes for any client.

Submissions

When you submit information through a form on the Site or email us, you represent that the information is accurate and that you have the right to share it. Submitting an inquiry does not create a client relationship with EPIC; that happens only through a signed agreement.

Please don't send us unsolicited creative ideas, proposals, or materials. If you do, you agree that we may use them without obligation or compensation to you, and that we have no duty to keep them confidential.

Third-party links and services

The Site links to third-party websites and services, including client sites, media outlets, publishers, social platforms, and tools we use to operate the Site. We don't control and aren't responsible for their content, availability, or practices. Linking doesn't imply endorsement. Your use of third-party sites is governed by their terms and policies.

Privacy

Our collection and use of information through the Site is described in our Privacy Policy, which is part of these Terms.

Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, EPIC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any content is accurate, complete, or current.

Information on the Site is general in nature and is not professional advice of any kind, including legal, financial, or fundraising advice. Decisions you make based on Site content are your responsibility.

Limitation of liability

To the fullest extent permitted by law, EPIC and its members, managers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if we've been advised of the possibility of such damages.

Our total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars ($100).

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless EPIC and its members, managers, employees, contractors, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third party's rights.

Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Lake County, Ohio, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at hello@epic.inc and make a good-faith effort to resolve the matter informally for at least thirty (30) days.

Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we'll change the effective date at the top. Continued use of the Site after changes means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision isn't a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and EPIC regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
